Lawsuit Filed July 20, 2006

Richard Davis and Trademark Properties have filed a lawsuit against A&E Television Networks and Departure Films. You can read the complaint via PDF. Remember, a complaint represents but one side of a legal argument.

Several newspapers have covered the story including the Charleston Post and Courier and Reuters.

The lawsuit seeks recovery on several different grounds.  A&E and Departure Films will be required to file an answer within thirty days.  It also appears that the Charleston, South Carolina Court of Common Pleas will require the case to go to Alternative Dispute Resolution (which will result in some of the details being revealed in private instead of in public court filings.)

I was so happy to hear that you guys are going to be back. A&E really may not know it now but the show is nothing without Trademark. I tried to watch the new season but it after 5min. I just had to change the channel. My husband is in the Military and so our housing is horrible So it’s nice to watch and dream about a house my husband and I can buy after he retires from the Air Force. Keep up the good work and I will be watching for the show to return.
    Thank you
    Maddy

Dont know if youll get to read this or not, but Flip this House isnt the same without the team from the South! I miss my friends! Tell me what network youll be on and Ill watch! The others are ok but you are in a class by yourselves. Miss you, Sheila

    Dear Richard,

I can’t beleive that you aren’t on the show anymore, Trademark made the show. I find the new shows are embarassing and am not quite show of A and E’s intent. I guess it is typical that network tv thinks that American viewers are quite dumb, your show was entertaining, and I truly miss seeing your show. I have a friend who went to Clemson from Brimingham, AL and he is a couple years younger than you but he was a Phi and did not know you. Anyway the show is horrible now and I can’t understand why A
@ E did whatr they did. Good luck in your lawsuit. Margaret Green. Natchez, MS.

  4. Cris says:

My husband and I are avid fans of Flip…from the South. Hate the one showing and never watched it. It so horrible; nothing like the Trademark Team. Good luck on the lawsuit. Richard, we admire your toughness, professionalism and fairness in your shows. Needless to say, very informative. Can’t wait to see you all again; different network sounds good! We all think Ginger is so sexy!!!

  5. Rachael & Danny says:

Trademark are the best, the others have no soul or integrity. We are having Trademark withdrawals & really love you guys, My hubby loves Ginger & says hi. I just love all of you guys. We want you back terribly. Good luck, YOU CAN DO IT !!!!

  6. Diane says:

Don’t know what A&E was thinking. New show is a bomb. Really enjoyed you and your team. You’re what professionalism is all about. Will be looking for your new show. Good Luck.

  7. Rick Mulcahy says:

A&E has NO IDEA HOW bad the series is without the Trademark Properties team. AS soon as Trademark is on TV, Please send me an email. The A&E series just airtime and dollars if they dont have Trademark Properties team on the A&E team.

  8. Dianne says:

I really don’t like the new teams and so do not watch the show. I watch for reruns of Trademark episodes only and if not on, change the channel. I am looking forward to watching new episodes with Trademark, where-ever, when-ever you get them aired. Good luck!

  9. Janet says:

I am from Toronto, Canada & have truly enjoyed Richard & the Trademark Properties team & their show. It is so very real, informative and the team truly talks and works from their hearts. It was very disappointing and sad to hear that there are no recent and new shows right now. I find the other 2 team shows are not as good as yours and they seem to be acting to the camera with their work being secondary. Your show was all about getting your every day work done with the camera being an incidental.
I do hope that your show comes back. My fingers are crossed.

  10. Kathy says:

I only watch the Trademark team on Flip This House. The other teams are not nearly as good and don’t do the quality work. I’m really looking forward to your new show on your new channel. We’re going to move to SC soon, and I always say that I’d love to buy a house that the Trademark team has flipped, you know the job was done right.

  11. Lonnie says:

I LOVE season one, with Trademark. Season two with the Montelogos can’t even compare. The show is nothing without trademark. Good luck, and PLEASE let me know what network your new show will be on, I will watch for sure!

  12. My family can not get enought of your show. We love Ginger and Richard so much.

Your company is like a group of friends to us.

Best to all, Ron & Family, Penfield, NY

  13. Deanna Golden says:

Where are you guys ” Trademark Properties….”I miss you and want to know what new network and when you will be on soon..

  14. Carol Frilam says:

I stopped watching “Flip…” after seeing one episode with the Montelongos–Those guys are nasty. Theatening people-their wives and waitresses included! They act like petty hoods.

  15. Bev Jenkins says:

Richard and The Trademark Team, I was Richards 2nd agent he ever hired and I learned the business from Richard. A&E is the loser here, his new show “The Real Deal” on TLC is GREAT and I wish Richard’s Team Trademark all the best!!!

  16. bea says:

    Dear Richard and staff,
Trademark Team is one of the best shows. I sometimes watch it a second time just to see if I missed something and because well, you seem like good friends who I have invited to my home. The Texans were brutal. The one brother needed anger management real bad to say the least. YOU ARE THE BEST.

  17. Dane Heard says:

My wife and I love to watch the Real Deal on TLC. We have learned so much about home improvement and real estate. We just wish that the show came on every day. Team Trademark seems like a big family and it is a real pleasure to watch!

  18. Jaque says:

Dear Richard, Ginger & Team Trademark,

You are all a class act! My family and I really enjoy watching what you all do and have fun being apart of it. You really make it seem easy and are inspiring to us who know it isn’t easy. Good luck with the Real Deal and we hope you all have continued success and many more seasons on TLC.

  19. Lisa says:

Richard and crew, I just wanted to say how much I enjoy watching you! I so wish I was able to do what you do for a living because I KNOW

  20. Lisa says:

Richard and crew, I just wanted to say how much I enjoy watching you! I so wish I was able to do what you do for a living because I KNOW I would rock! If only I lived in the Charleston area! Good luck with the lawsuit I hope you get everything you’re asking for and more! Oh, and by the way, I also agree with the other folks, those “people” in the second season SUCK and they certainly portray themselves as hoods to say the least! Where did they find these people?? Needless to say, I stopped watching “Flip this House” too!

  21. Sheri Mastin says:

Okay, I am must have been totally not paying attention… I wondered why a new cast and new part of the country… I watched the episode this past Sunday where Trademark’s merchandise store was opened in Charleston and just today decided to check out the website. I am shocked to find out about the lawsuit. You go Richard! Trust me, I will not watch now. It is no show without you guys! I hope it all works out for you. When will we know where to find you?
