Trademark on TLC in April

Mediaweek is reporting that Trademark’s new show “The Real Deal” which will feature renovation and resale with Richard Davis, will be on the air in April.  More details as they develop.

Lawsuit Updates

There are several upcoming deadlines.  A&E must identify their experts, and mediation must be complete by March 1.  All discovery should be completed by April 1.  Motions are due by April 16. 

I have pulled the new court documents and docket, and am in the process of writing a post to include the recent developments.  One thing that stands out to me, however, is that the parties appear to be having a dispute in discovery about the privacy of documents relating to the financial affairs the Defendants, with the fear that Richard Davis and Trademark will share them with TLC or other entities. They also point out (quite well, I think) that the Plaintiffs’ claim that there was to be a 50/50 split of the profits from the show hasn’t been yet demonstrated.  Unless Richard or Trademark can demonstrate that such an agreement existed, the Defendants’ financial affairs may not even be discoverable.  The Court has entered an order that allows the attorneys to mark documents as confidential; if they choose do so, the distribution of those documents will be tightly controlled.

The Defendants also seem to make inaccurate or misleading statements about my website in their pleadings.  This website is not operated by Richard Davis, Trademark Properties, or any of their employees or attorneys.  This website is operated by Mark Lyon, a fan of the original “Flip This House”. None of the parties to the lawsuit have the ability to do anything other than post comments to this website, though I will happily consider publishing anything they submit to me.

    Hey — I’ve heard that some South Carolina locals are a little ‘chilly’ toward Trademark Prop. because it is a Jewish owned company, with many of the profits going back to New York City and elsewhere and that the people involved in the company grossly inflate the South Carolina real-estate market for the sake of personal profit.

    Also heard that Richard, Ginger, and others are Jews — is this true? Would this be why many of the locals you all deal with are a bit ‘chilly’ toward ya’ll?

    I don’t understand why their religious preference would have anything to do with their business dealings?

    That’s news to me about people being “chilly”. In the show the community embraces Trademark, Richard and his employees. Don’t know where you get your info… but as far as I know Richard grew up in the south and continues to give back to his community so I can’t see why money would be going to NY?

    I grew up in SC and still live here. Richard Davis is a prime example of a good ole Charleston boy and Ginger is an example of a grit eating upstate girl. Those ya’lls are real!!!!! You can tell the difference. This is what made/will make the show so good. New York City!!!

    Good southern folks are laid back but will rise up and bite you in the butt if necessary!

    Say what you will about the Montegros. But if you look closely you may learn something. The reality is that there are rehabbers out there just like them. I almost bought a property that looked great cosmetically but new that they were selling me a lemon, and It was not something that was uncovered by an inspector. Its what i learened from the show.

    REAL ESTATE IS A BUSINESS, AND FLIPPING HOUSES DOES NOT MEAN REBUILDING THEM INTO A NEW HOME. BUYING A FLIPPED HOUSE, JUST MEANS THERE SHOULD BE LESS WORK FOR YOU AS THE NEW OWNER. YOU SHOULDN’T ASSUME THAT YOUR THE NEW OWNER OF A PERFECTLY GOOD HOUSE. THERE MAY BE SEVERAL THINGS NEEDING TO BE COMPLETED. ALSO, AS FAR AS TRADEMARK GOES.     I just want to say that I LOVE watching shows feauturing Trademark Properties. I am young enough to be Richard C. Davis’s daughter (probably!) but I think he is HOT. He has fantastic hair, a fiery (yet lamb-like) persona, and I love the way he treats people. With dignity.

    #1 – Religion has NOTHING to do with this and you sound like a racist pig.

    #2 – Flipping Homes in general inflates real estate costs. (think about it for about 5 minutes and youll see why). They take low budget homes, and ‘flip’ them into homes worth sometimes twice as much. This increases not only the value of the fixed home, but the neighbors and neighborhoods as well. It is one major drawback to the business and makes SOME people upset (ones that cant afford to live there any more). I know Richard doesnt do this on purpose, but its part of the industry. EVERYONE who flips homes is guilty of this. Does it make it wrong? I dont think so. Does it make them bad people? NO! In my opinion there helping, because they take homes that NO ONE will buy .. and making them homes EVERYONE wants. Great idea IMO.

    #3 – Inflating local properties, and then not keeping the profits in that community probably isn’t good for their economy. But its certainly not illegal OR immoral. If they want to spend in NYC, that is there option. Yes it might negatively effect, NC economy, but think of the gratefulness NY will have of them! If its really that big of a problem .. A) the government can try to step in. or B) Start your own damn company! Dont blame a man for ‘being too successful’.

    I love this show because of the PEOPLE in it. The whole trademark team treats people with dignity and resolves conflicts fairly. I’ve learned a lot about flipping and about conflict and problem resolution from watching the show. There are many dysfunctional and toxic companies out there; Richard has created a team environment and he doesn’t just talk the talk, he lives it every day – at work and even when coaching his son’s baseball team. I wish I worked for Trademark so I could learn The Trademark Way from the source. I can’t wait for The Real Deal to start airing on TLC.

    Obviously, the person that wrote about Charleston people being “chiily” about Jewish people DOES NOT live in Charleston. I’ve lived here for forty years about nothing could be further from the truth. I don’t know if Richard Davis is Jewish and could care less. Charleston judges people about how fair they are to their employees and customers. Do they give back to their community? Are they loyal to their friends? Charleston is about people “loving” people and not about looking for reasons to dislike them!
    Get over yourself!

    I can’t wait to see the new show, and think all of you guys are great! My husband and I are huge fans, and will continue to support the Trademark Prop. group! We are so bummed that we missed the debut, but will be looking for it on TLC!

    I will be watching for the new show. I have been so dissapointed. I did not know of the trouble with A&E and have been bummed out with the new teams. I will now boycott A&E and Look Sooooo forward to seeing Trademark On T.L.C. I learn alot from the Trademark team and will be loyal to them for all their help!

    Can’t wait for the new show to get on the air. I saw a promo for it Sunday night, 4/08/07. Looks great. Read the court deposition…..looks like the lawsuit could go either way in my (non)legal opinion. Best of luck to Team Trademark.

    Just finished watching the “Real Deal” on TLC and was happy to see Richard and his team at work again. I thought the teams that replaced Trademark on A&E were awful. I was waiting with anticipation for this new show and was not disappointed.

    I dont know Richard but as always it seems whenever someone has success that someone else wants to bring them down. There are always people who hate just to hate (and be heard) and feel they are the important ones but reality strikes.
    I enjoy watching Richard and his team bring life to the show. Too bad A&E cant see a good thing like Richard can.

    I didn’t know about the issues with A&E but glad to see that TLC has picked it up.I have flipped properties for the last 4 years and absolutely love doing it.The profits are great (if you make one) but Richard says it best,”ITS MORE THAN JUST THE MONEY” and i have learned some valueable lessons over the years and what Trade Mark Properties goes through is THE REAL DEAL! much continued success to Trade Mark.As for the Royal JACK ASS who made the comment about the jewish remarks,”YOU TRUELY ARE A TESTIMONY TO THE DROP OUTS OF SOCIETY,AND YOUR JACK ASS COLLEGUES WOULD BE PROUD! LOSERRRRR….

    I really love the show. i think its the best show out there next to Property ladder. stop criticesing the team, just watch and learn and do the same thing. you only talk negative about people because you are not able to do what they do. so just watch and learn and do.

    L love this show. My husband and I record every show. I really enjoy watching Richard. He has a big heart, he is funny, and he obviously is good at what he does. We are going to take a trip to the south just to see TradeMarks new building and buy a t-shirt. We also want to meet Richard Davis. We would love to do something like this in Northern California. Keep up the great work and hopefully we will see you in October 2007.

    I’VE READ MOST OF THESE COMMENTS, SOME ANSWERS TO YOUR QUESTIONS ARE. I WAS A FRIEND OF RICHARDS IN HIGH SCHOOL. I DEALT WITH HIM IN 1 BUSINESS DEAL IN BUYING A HOME. I WAS LIED TO, MY WIFE INSULTED TO HER FACE (I WAS NOT THERE), AND CHEATED OUT OF SQUARE FOOTAGE IN A HOME I BOUGHT. 3 THINGS COME TO MINE THAT HE DID TO ME THAT HE COULD OF LOST HIS LICENSE FOR. THIS WAS DONE TO A OLD FRIEND, I HATE TO SEE WHATS BEEN DONE TO STRANGERS.

    I have a love for buying and selling homes and have done so several other states but here I am in Utah and the market is crazy and the people’s expectation are so unrealistic. I’m posting this to see if any one has advice for hadling this unique area and people please e-mail me.

    I was also wondering how to handel seller agents that wont give you a price on your property unless they list your property.
    They refuse to sell my property because I don’t want to hire them but richard always consults local realators and they just work with him and does not hire them?? Is this something just in Utah?
